Terms and Conditions

Welcome to Coloring Page Magic (the “Company,” “we,” “our,” or “us”). These Terms and Conditions (these “Terms”) govern your access to and use of our website, web application, and any related content, features, products, or services (collectively, the “Service”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

The Service is intended only for individuals who are 13 years of age or older. If you are under 18, you may use the Service only with the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements.

2. Account Registration & Security

You may need to create an account to access certain features of the Service. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your password and restrict access to your account.
  • Promptly update your account information as needed.
  • Notify us immediately at hi@coloringpagemagic.com of any unauthorized use or suspected breach of security.

3. Subscription Plans & Monthly Credits

The Service operates on annual and monthly subscriptions. Each plan grants you a limited, revocable license right called “Credits” that you can use to generate AI coloring pages during that billing cycle. Credits are:

  • not currency and have no cash value;
  • non-transferable and may not be sold or exchanged;
  • re-issued at the start of every monthly subscription period; and
  • forfeited at the end of the billing cycle if unused—no roll-over.

Credits may only be used during the active subscription period associated with the plan you purchased. If your subscription lapses or is cancelled, any remaining Credits expire immediately. The Company reserves the right to adjust plan pricing or Credit allotments with at least 14 calendar days’ notice to current subscribers.

4. Failed Generations & Limited Refund Policy

If a technical error prevents successful generation, email hi@coloringpagemagic.com within 24 hours of the failure. Your message must include:

  1. Your order or transaction ID.
  2. A description of what happened.
  3. A screenshot showing the error (if possible).

After review, the Company—at its sole discretion—may (i) re‑credit the lost Credits, (ii) re‑run the generation, or (iii) issue a refund.

5. Licenses & Use of Images

5.1 Your AI-Generated Images (Text-to-Image and Image-to-Image)

The Service relies on third-party AI model APIs (including OpenAI, Google Imagen, and Flux Image APIs from Black Forest Labs). Your use of any custom images you generate via the Service is subject to those providers’ license termsin addition to these Terms.

  • Paid plans: You may use your generated images for personal, educational, and commercial purposes, provided you have obtained all necessary rights and permissions for any third-party intellectual property (e.g., characters, brands, logos, trade dress, or fictional universes) that may be depicted or evoked.
  • Free plan: You may use your generated images for non-commercial use only, such as personal or educational use.
  • No rights to Third-Party IP: AI outputs that resemble well-known characters, brands, objects, elements, or universes do not grant you any rights in the underlying works, and you may not imply affiliation, sponsorship, or endorsement.
  • Your responsibility: You are solely responsible for your prompts and uploads and for securing any rights, permissions, or releases necessary for your intended use.
  • Similarity notice: Because the Service uses generative-AI models, similar prompts may produce outputs that are identical or substantially similar for multiple users (see Section 7).

5.2 Free Download Library (Non-Commercial Only)

Free coloring pages made available by the Company in its public library are provided strictly for personal, educational, and non-commercial use. You may not resell, license, distribute for profit, or otherwise commercially exploit these free downloads.

Third-party IP disclaimer. Some free pages may depict or resemble characters, brands, logos, trade dress, or fictional universes owned by their respective rightsholders. The Company is not affiliated with, sponsored by, or endorsed by any such rightsholder and does not claim any ownership in their intellectual property.

Takedown requests. If you are a rightsholder and wish to request removal of a page, please email hi@coloringpagemagic.com with details sufficient to identify the material and your rights. The Company may remove or restrict content at its discretion.

6. Prohibited Conduct & Content

You may not use the Service to create, upload, or share content that:

  • Depicts nudity, pornography, or sexually explicit material.
  • Sexualizes minors or depicts child sexual abuse material (CSAM).
  • Promotes hate, harassment, or violence toward a protected group or individual.
  • Contains extremist or terrorist content.
  • Includes defamatory statements, doxxing, or invasion of privacy.
  • Encourages self‑harm or depicts graphic violence.
  • Contains malware, phishing, or otherwise malicious code.
  • Infringes or misappropriates copyrights, trademarks, or other intellectual‑property rights.
  • Violates any applicable law or regulation.

7. AI‑Generated Output Disclaimer

Because the Service uses generative‑AI models, similar prompts may produce outputs that are identical or substantially similar for multiple users. The Company cannot guarantee that any output is unique or free from third‑party rights.

8. Beta Features

The Company may release features labeled “Beta,” “Preview,” or similar. Beta Features are provided as‑is, may contain bugs, and may be modified or removed at any time without notice.

9. Service Availability; Force Majeure

The Service is offered on a best‑effort basis. We may suspend or interrupt the Service for maintenance, security, or events beyond our reasonable control (including power failures, natural disasters, labor disputes, or governmental actions). The Company is not liable for any such downtime or resulting loss.

10. Intellectual Property

All trademarks, logos, and other proprietary materials displayed on the Service belong to the Company or its licensors. Except as expressly provided in these Terms, no right or license is granted to you.

11. Third‑Party Links & Services

The Service may contain links to third‑party websites or services. The Company is not responsible for the content or practices of those third parties.

12. Disclaimers; Limitation of Liability

The Service is provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, the Company disclaims all warranties, express or implied. In no event will the Company’s total liability exceed US $100 or the amount you paid in the three months preceding the claim—whichever is greater.

13. Governing Law

These Terms are governed by the laws of Hong Kong. You agree to submit to the exclusive jurisdiction of the courts located in Hong Kong for any dispute arising out of these Terms or the Service.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new “Last Updated” date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
